Non-Profit Organization Formation

There are multiple types of non-profit organizations that may qualify for exemption from income tax. Quite often, there may be more than one organizational form available for achieving the non-profit's objectives. The selection of the optimum organizational form, however, may have a dramatic impact on how the organization operates and how it achieves its objectives.

An organization's ability to accept charitable contributions, its ability to lobby, and the manner in which it reports to the taxing authorities are all affected by the type of organization that is selected. Thus, we spend considerable time with a new organization in understanding its objectives and in selecting the form of entity that will best satisfy its objectives. We guide the organization in implementing its formation strategy. We also work with key personnel, including board members, officers and staff in understanding their unique obligations to the organization and their roles in assuring that the organization is true to its exempt purpose.
